Former Midland Holiday Inn owner jailed for second time

Jeff Kern, the owner of the former Midland Holiday Inn property, was found in civil contempt by Judge Michael Carpenter of the Midland County 75th District Court on Monday and was arrested and jailed in the county jail. Midland.

Kern, 71, of Los Angeles, Calif., is scheduled to attend another hearing Wednesday, Sept. 21, in district court. His bail amounts are listed as $93,245 and $115,745.

“Because he had not paid any of the fines and costs ordered by the court, the judge found him in civil contempt and committed him to the Midland County Jail,” according to the district attorney. City of Midland, Jim Branson.

Kern was also jailed in August 2021 for failing to comply with demolition orders and failing to pay fines. At that time, the structure of the hotel was not yet completely demolished. Last January, the structure was demolished, but Branson told the Daily News the driveway and parking lot still needed to be removed and the site re-soiled.

Today, a fence still remains around the entire property on West Wackerly, just east of Eastman.

Branson said Tuesday that Kern was also found to be non-compliant with the demolition permit.

“All foundations, concrete, and walkways had to be removed under the demolition permit, and they weren’t,” Branson said.

The old hotel building had been abandoned and condemned since 2018. The city sued Kern in October 2020 to tear down the building and won the case in May 2021.
